FIELD OF HEROES CREATOR KIT END USER LICENSE AGREEMENT (EULA)

1. Introduction
Field of Heroes Creator Kit (“Creator Kit”) is a creation tool that enables people to create, develop, modify, or contribute content for Field of Heroes (“FoH Content”), and to upload, publish, or otherwise make FoH Content available to other users of Field of Heroes. A person who uses Creator Kit will be referred to in this document as a “Developer,” and all In-Game Content created, offered, displayed, made available, or arranged by Developers is “Developer-Made Content.” Gamieon provides tools for Developers to use (“Developer Tools”), and Creator Kit is one such Developer Tool. “End User” means any natural person, company, or other legal entity lawfully interacting with Field of Heroes.
These Field of Heroes Creator Kit Terms (“Creator Kit Terms”) are a contract between the Developer who accepts them (“you,” “your,” or “yours”) and Gamieon. These Creator Kit Terms supplement the Steam Subscriber Agreement (“Steam Subscriber Agreement”).
2. Intellectual Property Rights
Developer Ownership: Creator Kit, Field of Heroes, and all underlying assets, code, art, audio, design, trademarks, and intellectual property remain the sole property of Gamieon and its licensors.
User Content Ownership: You retain ownership of your original elements incorporated into User Content (e.g., custom code, unique artwork created from scratch). However, any User Content that incorporates, relies upon, or derives from Gamieon’s intellectual property is considered a derivative work owned by or licensed to Developer.
3. User Conduct & Content Restrictions
When creating and uploading User Content, you agree that you will not:
Include content that violates third-party intellectual property, privacy, or publicity rights (e.g., trademarked logos, copyrighted music, real-world athlete likenesses).
- Create or share content that is unlawful, defamatory, abusive, hateful, discriminatory, sexually explicit, or otherwise objectionable.
Embed malicious code, exploits, cheats, viruses, spyware, or scripts designed to tamper with Field of Heroes gameplay, online matchmaking, or player data.
4. Moderation and Content Removal
Right to Remove: Gamieon reserves the right to monitor, review, reject, or remove any User Content at its sole discretion, without prior notice, if it violates this Agreement or hurts the game’s community experience.
5. Termination This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Creator Kit and destroy all copies in your possession.
6. Disclaimer of Warranties & Limitation of Liability
“As-Is” Provision: The Creator Kit is provided “AS IS” without warranties of any kind, express or implied. Gamieon does not guarantee that the Creator Kit will be error-free, uninterrupted, or compatible with all hardware. Gamieon is not liable for
Liability Cap: To the maximum extent permitted by applicable law, Gamieon shall not be liable for any indirect, incidental, consequential, or special damages arising out of your use or inability to use the Creator Kit or User Content.
7. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Florida, U.S.A., without regard to its conflict of law provisions.
